Appeals court rejects challenge to 35W bridge contract

The Minnesota Court of Appeals has rejected a challenge to the state's decision to award the contract for the new Interstate 35W bridge to a Colorado contractor.

Construction executives Scott Sayer and Wendell Phillippi said the Minnesota Department of Transportation's selection process was flawed.

They were unsuccessful in blocking construction of the new bridge. But the appeals court agreed to consider their legal arguments, saying the interpretation of the state's "design-build" contracting law will likely affect significant future public projects.

In its ruling Tuesday, the appeals court decided a MnDOT committee that reviewed the bids acted within its discretion in choosing Flatiron Constructors, even though it wasn't the lowest bidder.
