Duluth man charged with kidnapping in federal court only

A Duluth man facing federal kidnapping charges will not face similar charges in state court at this time.

Todd Franik, 41, was charged with kidnapping in federal court in St. Paul Wednesday. Franik is accused of forcing a 13-year old girl into his car, driving her from Duluth to Wisconsin and sexually assaulting her. Federal charges were based on allegations that he crossed state lines.

According to Duluth Police spokesman Brad Wick, it remains possible that state charges could be filed, but that looks unlikely. St. Louis County Attorney Melanie Ford said no complaint was forwarded to her office and that typically if federal charges are filed, state charges are not pursued for the same crime.

Franik remains in federal custody with a detention hearing expected Monday.
