Teenager faces 13 years in Minneapolis drive-by shooting

A man faces 155 months in prison for his involvement in a drive-by shooting that paralyzed a 12-year-old girl last fall.

Marlon Lozano-Montano pleaded guilty to assault in the first degree for the benefit of a gang. He was 17 at the time of the shooting, but certified to stand trial as an adult.

Hennepin County Attorney Mike Freeman said members of the Surenos 13 gang attempted to shoot Vatos Locos gang members in south Minneapolis. Instead they hit Guadalupe Galeno Hernandez, who was standing outside a friend's house at 3400 Chicago Avenue S. Lozano-Montano was a passenger in the car.

"This is a tragic totally unnecessary crime.," Freeman said. "He's not the shooter, he's not the driver, but he was part of it. And that's what happens when people go out driving around and do stupid things. "

Freeman said his office was satisfied with Lozano-Montano's sentence, which was agreed to by Hennepin County Judge Janet Poston.

Trials are pending against the other two teenagers involved in the case.

Lozano-Montano's sentencing is scheduled for July 15.
