Duluth in court to declare store a nuisance

The city of Duluth is in court to try to convince a judge that a downtown store is a public nuisance because it doesn't have a license to sell synthetic drugs.

The city is trying to shut down the Last Place on Earth for one year. Law enforcement officials and a neighboring business owner testified Monday in State District Court that the shop has negatively affected the area.

The store's owner, Jim Carlson, and his attorney, Randy Tigue, argue the city's ordinance on synthetic drugs is unconstitutional and that the shop has never offered illegal drugs.

The Duluth News Tribune says several police officers testified the downtown area has improved significantly since a temporary injunction closed the store last month.
