The US Supreme Court is taking up the controversial issue again this term, and will try to determine if racial preferences level the playing field and enhance diversity, or result in racial discrimination that's unconstitutional.

The motion is "The Equal Protection Clause forbids racial preferences in state university admissions." YES: Stuart Taylor of Brookings and Roger Clegg of Center for Equal Opportunity. NO: Deborah Archer of New York Law School and Erwin Chemerinsky of Univ. of California, Irvine Law School.
