Man killed during Eagan police confrontation Sunday is identified

A man who died after being shot by police officers in Eagan on Sunday has been identified as 37-year-old Justin Lee Kulhanek-Derks. The two officers who fired at him during the incident are both on standard administrative leave.

Police were called to an apartment building on the 1200 block of Ironwood Lane shortly before noon on Sunday after reports that a man was firing a gun outside.

Officers approaching the area were fired upon by a man now identified as Kulhanek-Derks, according to a statement from the Minnesota Bureau of Criminal Apprehension, which is investigating the shooting. The agency said two officers returned fire.

The Hennepin County Medical Examiner's Office reports that Kulhanek-Derks died of a gunshot wound to the head. The report lists the apartment building as his home address.

The officers who fired their weapons have been identified as Sgt. Nathan Tennessen, who has served with the department for 18 years, and Officer Alison Burstein, who has served with the department for four years.

A spokesperson for the Eagan Police Department declined further comment on the shooting.

Investigators say they're not aware of any video of the shooting, and that officers weren't wearing body cameras. Once the BCA investigation is complete, the Dakota County Attorney's Office will review the evidence.

Court records show that a woman named Lynne Krook filed an order for protection against Kulhanek-Derks in 2015. The order for protection describes an incident on April 17, 2015, where Kulhanek-Derks went to her house while armed and drunk.

She wrote that he wouldn't say why he was there, but "left a note on the table about being a god." In another incident on Feb. 3, 2015 that was documented in the order, Krook said Kulhanek-Derks was drunk and attacked her son, who she said is a vulnerable adult.

When contacted by MPR News, Krook confirmed the details of the order of protection. Krook said she is shaken by Kulhanek-Derks' death, but didn't know what led up to the shooting.
