Who gets to pick the title for a ballot question?

It looks like the Minnesota Supreme Court will decide who gets to come up with the titles that will appear on the ballot this fall atop two proposed constitutional amendments.

The Minnesota Legislature passed bills that spell out the language of two amendment questions: one which defines marriage and another which changes how people register to vote. Those bills also include titles for the amendments, but Secretary of State Mark Ritchie contends that his office, not the Legislature, has the authority to pick the titles.

Dale Carpenter, a Constitutional Law professor at the University of Minnesota Law School, discussed the legal arguments in this case with Morning Edition host Phil Picardi.
