Federal judge: Ban on gun sales unconstitutional

A federal judge has potentially opened a new market in Chicago to gun dealers.

U.S. District Judge Edmond E. Chang said Monday that Chicago ordinances banning the sale of firearms within city limits are unconstitutional. The judge issued his ruling in a lawsuit brought by the Illinois Association of Firearms Retailers and three Chicago residents.

Chang noted Chicago's ban not only covers federally licensed dealers, but also gifts among family members, in the name of reducing gun violence.

Chang said a fundamental duty of government is to protect its citizens but it's also obligated to protect fundamental rights named in the Constitution, including the right to keep and bear arms for self-defense.

Chang said he would temporarily stay his ruling, meaning the ordinances stand while Chicago decides whether to appeal.
