The mother of Fong Lee has filed an appeal of the family's wrongful death lawsuit to the 8th Circuit Court of Appeals.

Lee was shot and killed by Minneapolis police officer Jason Andersen in 2006. The family lost their wrongful death lawsuit against Andersen this spring.

They based their lawsuit on the contention that Lee was unarmed when Andersen shot Lee eight times. Andersen testified that he saw Lee carrying a gun and fired at him because he feared for his life.

Meanwhile Andersen is on paid administrative leave over allegations of domestic violence. He was arrested in Big Lake in June on charges that he assaulted his girlfriend. The offense is a misdemeanor.
