Minn. deputies cleared in courthouse shooting

Two Sherburne County deputies will not be charged in the fatal shooting in October outside the Sherburne County Government Center.

Wright County Attorney Tom Kelly tells the St. Cloud Times that a review of the evidence shows the actions of Deputy Nicole Stottlemyre and Capt. Dan Andren were justified.

The shooting left 47-year-old Dana Dempsey dead. The Big Lake man pulled a handgun from his coat in the parking lot of the government center and fired it at deputies.

Kelly decided the use of force by Andren and Stottlemyre was necessary to protect the officers from death or great bodily harm.
