Democratic Sen. Al Franken is calling U.S. Supreme Court nominee Elena Kagan "brilliant and superbly qualified."

Franken is a member of the Senate Judiciary Committee, and will have a high profile opportunity to weigh-in on Kagan's nomination during her confirmation hearings.

Franken says he's not at all concerned that Kagan has never been a judge. He says her experience as solicitor general and her work in academia qualify her to sit on the highest court.

"People who I know who know her speak very very highly of her, and of course she's the first woman solicitor general and she's been doing a fabulous job as that. I think this is a very good nomination," he said.

Franken says he will consult Minnesota legal experts to help him develop confirmation hearing questions. Franken also participated in the confirmation hearings of Justice Sonia Sotomayor who was President Obama's first Supreme Court nominee.
