An attorney representing family members hurt and killed in the Koua Fong Lee accident says Lee's car is being moved out of police custody and into a private storage facility in the south suburbs of St. Paul.

Attorney Mike Padden says all parties involved in litigation against Toyota related to the Lee accident have agreed to the terms of a preservation stipulation, laying out the rules for access to the car as the civil suits move through the courts. Padden says the location of the storage facility will be kept private.

Attorneys for Lee, who has not filed a civil suit against Toyota, will control access to the car. Padden called the agreement "fair and reasonable" for all parties.

Lee's 1996 Toyota Camry had to be moved out of police custody, since the city no longer has jurisdiction over the vehicle.

Lee was freed from jail last month after prosecutors dropped charges against him in the 2006 accident that killed three people.
