MINNEAPOLIS (AP) -- The Minnesota Court of Appeals says a police officer's use of her squad car spotlight does not amount to an unlawful seizure.
Michael Anthony Clark appealed his conviction on unlawful possession of a firearm. Clark was arrested in February 2009 when the officer shined the spotlight on him and his brother as they walked in Minneapolis.
The officer was responding to a report of two men carrying shotguns. The two men ran off as the officer approached. During a subsequent chase, Clark dropped a handgun.
The St. Paul Pioneer Press says Clark argued in his appeal that evidence of the gun should not have been admitted in court because it was the result of an unconstitutional seizure -- the spotlight.
