FARGO, N.D. (AP) -- A Fargo surgeon accused of drugging and sexually assaulting his wife is back in court hoping to convince a judge to throw out the case against him.
Jon Norberg is accused of having sex with Alonna Norberg after giving her propofol, a medication that gained notoriety during the trial against the doctor who treated pop star Michael Jackson. Jon Norberg backed out of a plea deal with prosecutors earlier this spring because he felt it might affect his pending divorce case.
Judge Douglas Herman is now determining whether prosecutors have enough evidence to move the case forward to trial.
The Associated Press typically does not identify victims of sex crimes but Alonna Norberg has spoken publicly about the case.
