Man ordered released from ICE custody nearly a week ago still not home

Attorneys representing a man detained by U.S. Immigration and Customs Enforcement said the Department of Homeland Security is not complying with a federal judge’s order to release him.
According to documents filed in federal court Wednesday, a Guatemalan man seeking asylum in the United States was detained Jan. 10. The man filed a habeas corpus petition challenging his detention the next day that was granted Jan. 15.
The judge ordered the man to be released within 48 hours of the issuance of the order.
However, attorneys say sometime between the day he was detained and the day of the release order, DHS transferred the man to Texas, “despite the fact that this Court’s order required the immediate release of the Petitioner in Minnesota,” according to a memo filed on behalf of the man, who was later transferred to to Albuquerque, N.M.
Attorneys filed a motion to hold DHS in contempt six days after the judge’s release order was issued.
The attorneys are also calling for the courts to enforce similar release orders and to block DHS from transporting people like their client to detention centers out of state.
