The Minnesota Department of Health says they have won round one in its efforts to close the curtain on "Theater Nights" across the state. The state agency took an Elko bar to court for allowing smoking even though there is a statewide indoor smoking ban on the books. The bar (and other bars) is arguing that they can allow indoor smoking because of an exemption for theatrical performances. Here's the judge's temporary injunction.
