Suit: Walmart sells too many groceries at St. Paul store

Walmart and Supervalu are engaged in a fight over food at St. Paul's Midway Marketplace shopping center.

Supervalu operates a Cub Foods store at the shopping center and the company charges the Walmart that's also there is selling far more groceries than permitted under lease terms designed to protect Cub from competition.

Supervalu and the center's landlord have sued Walmart in Ramsey County District Court, asking a judge to force the world's biggest retailer to scale back the grocery section in the Midway store.

Walmart spokesman Greg Rossiter says the store has been selling dairy products, frozen meat, baked goods and many other groceries for years and is not violating its lease.

"We have been serving customers in St. Paul at that store for their grocery and general merchandise needs for several years," he said. "And we expect that to continue."

Walmart recently remodeled the store's grocery section. But it says it didn't add a lot more grocery items for sale.
