No felony charges for mom in holding pond crash, deaths

A driver whose car plunged into a stormwater holding pond last November in St. Louis Park, killing two children, will not be charged with a felony.

Marion Guerrido was behind the wheel when her car veered out of control on a highway ramp. There were five small children in the car with her and it took emergency crews several minutes to rescue the children from the deep water.

Seven-year-old Alarious Guerrido and 5-year-old Zen'Avia Rennie died.

Hennepin County Attorney Mike Freeman says Guerrido will not be charged with a felony in connection with the incident.

The accident reconstruction, tests and interviews with Guerrido indicate she was not speeding, did not have drugs or alcohol in her system and had not been on her cell phone at the time of the crash. Investigators say she overcorrected and spun out. However, Guerrido was driving with only a learner's permit according to investigators - and there was no licensed driver in the car with her as the law requires. It is not clear yet whether she will be ticketed for violating the conditions of the learner's permit
