Minnesota U.S. Attorney Dan Rosen Thursday dropped charges against two men accused of assaulting an immigration officer. 

Authorities had alleged that on Jan. 14 Julio Sosa-Celis and his friend Alfredo Aljorna attacked an ICE agent with a broom and shovel.  

The men retreated into a north Minneapolis apartment building, and the ICE agent fired his gun through the front door and struck Sosa-Celis in his right thigh. Four children were inside. The round landed in a wall near a child's playpen.

 that she witnessed the incident and the government's allegations are untrue. 

In their motion to dismiss the charges of assaulting a federal officer, prosecutors write that newly discovered evidence is "materially inconsistent with the allegations."

The men's families say in a statement that they're overjoyed with the move; they're calling for the ICE agent to be identified and criminally charged.
