A federal judge is set to hear testimony Tuesday from U.S. citizens and immigrants in Minnesota — some of whom are asylum seekers or are lawful permanent residents — who say federal agents stopped and arrested them without warrants or probable cause. 

The witnesses are part of a class action lawsuit filed by the American Civil Liberties Union, which alleges Somali and Latino residents were racially profiled during recent federal operations in the state. The suit accuses U.S. Immigration and Customs Enforcement of violating the constitutional rights of people targeted by officers for arrest and detention. 

The plaintiffs are asking the court to block those practices while the case moves forward. 

Among the witnesses scheduled to testify is Mubashir Hussen, a 20-year-old Somali American who is a U.S. citizen. 

According to the lawsuit, Hussen was detained by ICE officers on Dec. 10, 2025, despite Hussen’s multiple attempts to show proof of his citizenship. 

“Due to his Somali identity, Mr. Hussen is terrified of being arrested and detained again,” reads the lawsuit. 

However, DHS officials say plaintiffs like Hussen “fail to show that a single plaintiff or nonparty declarant is threatened by a real and immediate risk of future injury,” reads a court reply. 

“That absence of any immediate risk is demonstrated by various declarants alleging that ICE officers are in their neighborhood nearly every day — yet none allege being subjected to repeated unlawful conduct.”

After Tuesday’s testimony, legal arguments in the lawsuit are scheduled for Wednesday.
