The mother of a man fatally shot in the Nordstrom store at the Mall of America in 2022 has filed a wrongful death lawsuit against the store and the mall.
The complaint filed earlier this month by Lynn Hudson claims Nordstrom and the Mall of America were negligent and that both failed to provide adequate security on the day that her son, 19-year-old Johntae Hudson, was killed.
That gunfire followed a fight and chase through the store in December 2022. Two suspects were later each sentenced to 30 years in prison for the shooting.
Among other claims, the new lawsuit alleges the mall and the store did not have enough security in place and did not adequately respond to reports of people — possibly armed — running through the mall just before Johntae Hudson was shot.
It also points to past incidents of violence at the mall — including gunfire that prompted a lockdown in August 2022, and a shooting that left two people injured in December 2021 — as evidence that the mall and store should have known that additional security was needed.
The lawsuit seeks financial damages.
Nordstrom has filed a legal response denying the claims and asking that the lawsuit be dismissed. The Mall of America told MPR News that it can’t comment on pending litigation.
